Federal judge suspects Attorney General Holder conspired to violate a citizen’s constitutional rights

On January 13, 2012, Judge Kenneth L. Ryskamp, a senior judge of the U.S. District Court for the Southern District of Florida who has served on the federal bench for over 25 years, entered an order stating his suspicion that Attorney General Eric Holder actively conspired to violate the constitutional rights of an American citizen.

Yes, really.

In the case of Holder v. Pine, Holder’s Justice Department prosecuted a woman for disseminating literature in front of an abortion clinic.  You see, in Barack Obama’s America, expressing a pro-life view is treated as a criminal act that warrants using the full weight and power of the federal government to prosecute.

Judge Ryskamp summarily dismissed this case as a matter of law without a trial because the charge was so facially violative of Ms. Pine’s First Amendment rights.  On this subject, Judge Ryskamp wrote, “The Court is at a loss as to why the Government chose to prosecute this particular case in the first place.”

Judge Ryskamp answered his own question in footnote 6 of his dismissal order:

It is rather curious that the Department of Justice was able to meet with the [Presidential Women’s Center] staff and police officers the very next day after the alleged violation occurred. It is also curious that the Government failed to make any efforts to obtain the identities of the passengers who are the alleged victims in this case—the Court finds it hard to believe that the Government was completely unaware of the existence of the sign-in sheets and video surveillance system. The Court can only wonder whether this action was the product of a concerted effort between the Government and the PWC, which began well before the date of the incident at issue, to quell Ms. Pine’s activities rather than to vindicate the rights of those allegedly aggrieved by Ms. Pine’s conduct. If this is the case, the Court would be inclined to sanction the Government with, at a minimum, an adverse inference. Given the absence of further evidence substantiating the Court’s suspicions, the Court is not authorized to do so.  (Emphasis added.)

In other words, an abortion clinic didn’t like that a pro-life activist was expressing opposition to abortion outside of its facility, and the court has signaled that it believes that Eric Holder likely conspired with that clinic to violate that person’s First Amendment rights by planning in advance to prosecute her for exercising them.

And, once again, the silence of the “news” media in the face of Holder’s abuse of his power as America’s chief law enforcement office is deafening.

When President George W. Bush began to send foreign enemy combatants to Guantanamo Bay, the left and their loyal “news” media screamed from the rafters about civil rights.  But two months ago, when America’s chief law enforcement official was accused by a federal judge of violating an American citizen’s constitutional rights, no one in the “news” media found it newsworthy.

This year’s election is about more important things than whether health insurers should be forced to provide unlimited contraceptives to frisky female law students.  It’s about whether we are going to continue to exist as a free constitutional republic.  If Barack Obama, Eric Holder, and their “news” media allies get their way, our constitutional rights will soon be as dead as journalism already is in America.
