Bolling: U.S. Supreme Court and Roe v Wade

Much has been written in recent days about the possibility that the U.S. Supreme Court could reverse the 1972 decision in Roe v Wade, which held that a women’s right to an abortion was guaranteed under an implied constitutional right of privacy.

If the draft opinion recently leaked to the press is correct, it appears as though the court may be inclined to reverse course and rule that the Constitution does not actually create a right to privacy, thus undermining the very foundation of the prior opinion in Roe.

This creates an interesting question: How often does the Supreme Court change course and reverse an opinion handed down by a prior court?

While this doesn’t happen often, there are plenty of examples in American history where one Supreme Court has reversed the opinion of a prior Supreme Court. Perhaps the most significant of these was the 1954 decision in Brown v Board of Education, which ordered integration of the public schools, thus reversing the prior decision in Plessy v Ferguson, which had approved segregation.
