John Foust’s Filing Follies

John Foust, Democratic candidate for Virginia’s 10th Congressional District, has had a rough time of it lately. First he demeans women, federal workers, and his own staff by questioning whether or not Barbara Comstock has worked a “real job” (Spoiler: She has). Then he had a TERRIBLE first debate against Barbara Comstock where he not only failed to show that he understood any of the concerns of the room but he also took THREE positions on Keystone XL. Three!

So, desperate for traction and to change the narrative from just how terrible of a candidate John Foust is, the Washington Post swung into action, following this week’s conviction of Bob McDonnell with an article meant to paint Barbara Comstock for… well, not entirely sure. Because despite the sensationalist headline, the hit fell flat:

Northern Virginia congressional candidate Barbara J. Comstock failed to report that a public-relations company she owns took in a total of $85,000 in 2012 trying to help Mitt Romney become president, an apparent breach of congressional ethics rules.

On Friday, an aide to Comstock, the Republican nominee in the race to replace retiring U.S. Rep. Frank R. Wolf (R-Va.), said that the oversight was unintentional and that the campaign was working to correct the problem after being contacted by The Washington Post.

That’s it.

Meanwhile, the Washington Post hasn’t spent a single drop of ink covering the fact that the FEC has requested that John Foust clarify some issues with his campaign finance filings – or actually face “enforcement action.”

So why is this a big deal? Because John Foust’s campaign wants it to be a big deal. In particular, his campaign manager, Shaun Daniels:

“It’s a little hard to believe that someone who made a career out of being an attorney, an investigator and an opposition researcher could have that big of an oversight,” said Shaun Daniels, campaign manager for Foust. “She’s been running away from her record and running away from her past.”

Here’s the thing, the House Ethics Committee says it’s not a big deal:

The Committee recognizes that unknowing failures to report such items are not uncommon. Such errors and omissions are typically corrected through amendments to Financial Disclosure Statements, and do not involve any further Committee action.

So why is John Foust’s campaign trying to make hay of this? Because Shaun Daniels tried this before, as campaign manager to Rush Holt for Senate in New Jersey – where he tried to play this card against eventual winner Cory Booker only with an embarrassing twist:

In a televised debate last night, Holt – along with Rep. Frank Pallone – suggested Booker needs to be more transparent about his relationship with Waywire, the social media company he founded last year with two Internet entrepreneurs.

Booker was asked to clarify his financial connection to Waywire during a campaign event in Elizabeth today. But he went after Holt instead.

“Rush Holt has not filed his disclosure forms. We’ve disclosed everything,” Booker said. “He’s in the middle of an election, disclosure forms were due in May, and he hasn’t filed them.”

Whoops!

Barbara Comstock has made no secret of her resume and has shown to be proud of her work on behalf of not just Mitt Romney and the RNC but for the people of the 10th Congressional District while she worked with Rep. Frank Wolf, or as a Delegate in Richmond, or as a mom at home.

This is a distraction and John Foust and Shaun Daniels know it – heck, Shaun Daniels should know better.

But it failed for one candidate, why not try it for another?
