Goodlatte clarifies EPA amendment

In a NewsLeader editorial yesterday, Rep. Bob Goodlatte sought to correct mis-information on his amendment to the February House Continuing Resolution.

Goodlatte’s amendment cut funding for implementation of the EPA’s Total Maximum Daily Load (TMDL) standards for the Chesapeake Bay. In a statement released after the passage of his amendment, Goodlatte said that these limits were “heavy-handed … one-size-fits-all mandates from Washington, D.C. that overturn state rules and give more power to federal bureaucrats. ”

The Virginia delegation’s vote on Goodlatte’s amendment broke along party lines, with Democrats opposing it, and Republicans, except for Rep. Rob Wittman, supporting it. State delegate, Harvey Morgan, has also questioned the amendment.

In yesterday’s editorial, Goodlatte argues that EPA’s limits constitute a property taking by another name.

these limits will dramatically restrict land usages for everyone who lives and works in the Watershed. At the same time, the EPA is seeking to expand their regulatory authority by seizing authority granted to the states and converting the cleanup efforts to a process that is a top down approach with mandatory regulations. EPA’s overreach is seen in the Watershed Implementation Plans (WIPs). While the EPA will say that each state is responsible for their own plan, nothing could be further from the truth. The EPA used the threat of a “federal backstop” or consequences to force the states to write the plans how the EPA wished. I believe that each state knows better how to manage a state’s water quality goals than the bureaucrats at the EPA.

Further, “The cost of complying with these requirements will be devastating during our current economic downturn, resulting in many billions of dollars in economic losses to states, localities, and industries large and small.”

Far from stopping Bay cleanup efforts, which he supports, Goodlatte says that his amendment will not inhibit state programs, the EPA’s Bay restoration programs or other voluntary federal programs. It only addresses the implementation of the TDML mandates. Goodlatte says that the EPA should treat private property owners as partners in Bay restoration and preservation efforts, rather than casting them as villains.
