Not Larry Sabato – Lobbyists, Governments and money

Not Larry Sabato has an interesting post delving into General Assembly lobbying that was sparked by the big dollar events for donors at the Homestead. His initial complaint was concerning the propriety of such events, and current gift laws and how some say they skirt them.

Today, he broadens the sunlight to include a lobbying firm with both private and public sector clients.

It boils down to this: Kemper Consulting has as its clients government entities from HRT to local governments, who can’t legally donate to campaigns.

Kemper also has private sector clients who have donated in their own name frequently and don’t need a lobbyist to do it for them.

So, where does Kemper’s donation money come from? Doesn’t this make a lobbying firm an effective pass-through for donations that can’t otherwise be made? (NLS doesn’t say “laundering” but his implications are clear)

NLS’ argument is you really can’t tell whose retainers fund the donations. If it’s private sector retainers that fund them, does that have tax implications for the client? If it’s public sector, how proper is that?

Certainly, once Kemper is paid a retainer, it’s Kemper’s money. It can spend it however it likes. But it does appear to me that some sort of accounting wall should exist to make sure that taxpayer funds don’t wind up in campaigns.
