Sotomayer – Some genders are more equal than others
By Brian Kirwin | Tuesday, June 16th, 2009 | UncategorizedIt was bad enough when Obama Supreme Court nominee said “a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male.”
Now we learn she’s a member of an elite all-women’s club, she says that the club doesn’t discriminate.
Doesn’t this all sound familiar?
Recalling her decision in the New Haven firefighters case, where the city denied raises to those who earned them because the the test was somehow discriminatory. She thought the white firefighters had no claim of reverse discrimination.
So, if minorities are hurt by a policy decision, that’s discrimination. If whites are, it’s not.
Now a female-only club is not discriminatory?
Sotomayer claims that the club doesn’t discriminate on purpose. Since when does intention matter in discrimination cases? Isn’t it impact that’s judged?
“To the best of my knowledge, a man has never asked to be considered for membership. It is also my understanding that all interested individuals are duly considered by the membership committee.”
Well, if no man has ever asked, then how do we know what the membership committee would do? And how many women who joined did so thinking that men could just flood the organization at a moment’s notice?
And let’s just apply her logic to other discrimination. Would “they never asked” be a reasonable defense of all-white groups? All male groups? We’ve seen courts challenge hiring practices simply because the demographics of employees don’t match the demographics of a community.
Now we’re considering appointing for life to the Supreme Court someone who thinks her gender makes her better than other judges, her race makes her better than other races, and believes her all-female club is only all-female because no male ever asked to join, and if one did, he’d be welcomed with open arms.
The left created these rules. It’s time they abide by them.

Sorry, dude. As conservative as I am, I’m just not with you on this one. The availability of business contacts at the men-only business clubs vastly outnumber those at any women-only groups. And if there is an open club, the men will still congregate with men and women with women. It is not racism or sexism to have more in common with people who are similar to you and have had similar experiences, and to more readily for friendships with similar people.
As such, women would still be at a disadvantage in clubs that do not discriminate.
As I recall from childhood, the membership of the quilting group my Mother participated in was made up only of women. Now did this group discriminate against men or is the explanation that no men were interested in participating?
Is it going to be held against a male prospective Justice if he belongs to a Rugby club that can’t find a single woman willing to join up?
There are no men only business clubs left. Kiwanis, Rotary, Lions, Ruritan, etc have all gone co-ed.
However, if you are really “conservative” then you should champion everyone’s freedom of association. Rather than using Soto’s IWF membership as a bludgeon, use it as leverage to return some sanity to society and our government.
If a political figure wants to join an all-Jewish club, an all-Black or all-White club, that should be no concern of anyone else, no more than if the same person played golf at the nation’s most diverse golf club, every Wednesday.
Now that we are in a new century, let’s elevate the debate to issues of substance and leave the chicken-shit “gotcha” politics behind. It is time for the citizens to demand that issues of real substance be discussed in our elected bodies, including during confirmation hearings.
Judge Soto is nothing but an affirmative action abomination. She has no substantive legal talent and has only gotten to where she is because of her being the token Latina.
There are plenty of issues with her record that she can be held accountable for, such as her goof-ups in supporting racial/gender quotas. She needn’t be slammed for choosing to affiliate with the lesbian-controlled, IWF, or any other odd group of her choosing.
Clairese,
I think you go a little too far with your statement:
“If a political figure wants to join an all-Jewish club, an all-Black or all-White club, that should be no concern of anyone else, no more than if the same person played golf at the nation’s most diverse golf club, every Wednesday.”
This might be an extreme example, but I would have a problem with a prospective Justice who belonged to the KKK, with the reason being that there were no black members of the KKK was that every black person who applied ended up being lynched.
Less extreme might be the prospective Justice who is a member of a golf club that denies membership to some of those who apply only because of race.
Well, David, I’m glad at least somebody feels that Senator Byrd of W.VA. shouldn’t be a judge. At least Byrd only helps write laws rather than interpret them, right?
Just stirring the pot…………….
